2026-27 TERMS & CONDITIONS

PROGRAM TERMS & CONDITIONS

1. The 2026–27 Gems Discount Card provides each cardholder with a non-transferable, non-refundable discount card that entitles the cardholder to whom a card is issued to obtain discounts, subject to the terms and conditions set forth below, at participating Colorado Ski Country USA (CSCUSA) member resorts during the 2026–27 season. All CSCUSA participating resorts (Gems) reserve the right to withdraw from the program at any time and to restrict or prohibit discount lift tickets obtained using the Gems Discount Card. Gems Discount Cards cannot be used in conjunction with other resort offers and may be prohibited from being used by participants in special events, races, or competitions of any kind.
2. The following CSCUSA resorts are participating for the 2026–2027 season: Arapahoe Basin, Cooper, Echo Mountain, Eldora, Granby Ranch, Loveland Ski Area, Monarch Mountain, Powderhorn, Purgatory, and Sunlight.
3. The Gems Discount Card is valid at participating CSCUSA member resorts during the 2026–27 ski season. The Gems Discount Card may be used to obtain no more than two (2) days of discount tickets at each participating CSCUSA Gems resort during the winter season. The Gems Discount Card is not valid December 25, 2026–January 1, 2027; January 16, 2027–January 17, 2027; and February 13, 2027–February 14, 2027, and is subject to additional blackout dates, opening and closing dates, and operational limitations. Late season opening, mid-season, and/or early season closing do not warrant refunds or transfers.
4. The discount options provided on the Gems Discount Card are: Each participating resort provides each Gems Discount Card holder the option to purchase a one-day lift ticket at a specified ticketed price for either mid-week or weekend pricing in early/late season or mid-season.
5. The Gems Discount Card discount is not guaranteed to be the lowest available ticket price at any participating Gems ski area on a given day. Lift tickets obtained with the Gems Discount Card may not be transferred or re-sold to any other person, including family members or relatives.
6. It is a violation of Colorado law to resell lift tickets. CSCUSA will immediately revoke a Gems Discount Card if the cardholder transfers use of the Card, or of any lift ticket obtained with the Gems Discount Card, to another person for monetary consideration or otherwise.
7. Many CSCUSA member ski areas are now requiring or allowing advance online purchase of day lift tickets, including those using a discount card such as the Gems Discount Card. Gems Discount Card holders should check their Pass Portal for specific instructions about which Gems ski areas accept or require advance purchase of tickets using the Gems Discount Card. At ski areas not accepting or requiring advance purchase of tickets using the Gems Discount Card, the Gems Discount Card holder must appear at the lift ticket window each time the cardholder wishes to obtain a discounted lift ticket. When appearing at the ticket window, the Gems Discount Card holder must present a 2026–27 validation email and a photo I.D. matching the name on the validation email to the lift ticket office on the day of purchase. One discount option may be obtained per day.
8. Gems Discount Card holders are responsible for proper use of the pass at all times. CSCUSA will revoke and cancel a Gems Discount Card without notice for any misuse. In the event of pass misuse and cancellation, CSCUSA may recover damages to CSCUSA and/or to participating CSCUSA member resorts arising from pass misuse, including reasonable attorney’s fees. CSCUSA reserves the right to modify, suspend, or cancel the Gems Discount Card Program, or any program benefits, at any time with or without notice. CSCUSA is not responsible for expenses incurred or opportunities foregone by Gems Discount Card holders if CSCUSA modifies or cancels the program. All Gems Discount Card holders agree to comply with all rules of participating CSCUSA member resorts and with all applicable laws and regulations, including the Colorado Ski Safety Act. All information provided in the purchase may be collected, retained, and used by CSCUSA and its member resorts for verification, marketing, research, and operational purposes in accordance with CSCUSA privacy practices.

ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS

The undersigned purchaser (“purchaser”) for the Gems Discount Card agree that they have read, understand, and agree to comply with the terms and conditions of the Gems Program set forth above. The undersigned acknowledge and understand that the purchaser who gains lift ticket access, as a “skier,” ASSUMES THE RISK of the dangers and conditions which are part of the sport of skiing under Colorado Law. Purchaser acknowledges that falls and collisions occur, and injuries or death may result from participation in the sport of skiing.

COLORADO SKI SAFETY WARNING

Purchaser acknowledges the following WARNING:

Under Colorado law, a skier assumes the risk of any injury to person or property resulting from any of the inherent dangers and risks of skiing and may not recover from any ski area operator for any injury resulting from the inherent dangers and risks of skiing, including: Changing weather conditions; existing and changing snow conditions; bare spots, rocks, stumps, trees; collisions with natural objects, man-made objects or other skiers; variations in terrain; and the failure of skiers to ski within their own abilities.

Discount Card Holders further acknowledges that Colorado law also includes cliffs, jumps and extreme and freestyle terrain in the inherent risks of skiing, that falls and collisions occur and that injuries, paralysis and/or death may result from skiing. Discount Card Holders acknowledge that a skier assumes responsibility for maintaining control at all times while skiing, that a skier is responsible for reading, understanding and complying with signage, including instructions for use of lifts, that a skier must have the physical dexterity and knowledge to safely load, ride and unload lifts, that a skier may encounter snowmobiles, snow grooming equipment, snowmaking equipment or other vehicles or equipment at any time and that a skier must be alert for and avoid such equipment. Discount Card Holders further acknowledge that the use of ski area facilities involves risks including but not limited to the risks mentioned above, high elevation, marked and unmarked obstacles, the possibility of negligent rescue, avalanches and/or movement of snow, slick or uneven walking surfaces, surfaces covered with ice and snow and rugged mountainous terrain.

RELEASE OF LIABILITY AND AGREEMENT TO INDEMNIFY

Purchaser hereby ASSUME ALL RISKS associated with the Cardholder’s participation in the Program, known or unknown, inherent or otherwise, including but not limited to, injury and/or death to the Cardholder, and HEREBY RELEASE CSCUSA, its participating member resorts, Program partners and sponsors, respective subsidiaries, affiliates, directors, officers, employees and agents (the “Released Parties”) from ANY AND ALL LIABILITY and/or claims that the undersigned Purchaser may be entitled to bring that arise from the purchaser’s participation in the Program, including claims based on NEGLIGENCE OR BREACH OF WARRANTY. The Purchaser AGREES TO INDEMNIFY and hold harmless the Released Parties from any and all claims of the Cardholder or additional participants arising in whole or in part from the Purchaser’s participation in the Program. In consideration for participation in the Program, the Purchaser agree that all claims for injury and/or death arising from the Purchaser’s participation in the program shall be governed by the law of the State of Colorado, and exclusive jurisdiction of any claim shall be in the State or Federal Courts of the State of Colorado.

ACKNOWLEDGEMENT AND ACCEPTANCE

With full knowledge of the above-described Terms & Conditions, I am agreeing to the above assumption of risk and release of liability agreement and agreement to indemnify. I have read this agreement carefully; I fully understand its contents, and I voluntarily agree to its terms.
